Autopay Agreement

You authorize Ava Finance, Inc. (including its subsidiaries and affiliates ("Ava," "we," "us," "our")) to withdraw the minimum payment due amount each month from your

checking account, credit card, or debit card (collectively, Payment Method) one week after your statement closing date. You certify you are the owner of the Payment Method and you have the authority to authorize storage of and charges to the Payment Method you provided. Any withdrawal from a checking account will be governed by the National Automated Clearing House Association (Nacha) Rules. You understand that this authorization to pay your monthly minimum payment by recurring charges or debits is entirely optional and is not required to obtain or maintain your account with Ava.

Your minimum monthly payment is calculated each month on your statement closing date and disclosed to you in writing on your statement. By checking the “I have read and accept the Autopay terms” box, you have indicated that you understand that, if your balance increases, your minimum payment due amount may also increase and the amount withdrawn from your payment account will automatically increase accordingly. If your minimum payment varies in amount from the previous payments, we will notify you of the amount and date of the transfer at least ten days before the date of the scheduled payment. Any payments or credits posted within the same month’s billing cycle will not change the amount automatically withdrawn. All transactions will be in U.S. dollars.

You are responsible and liable for all authorized transactions made under this preauthorized transfer agreement. Ava will not be held liable for any fees your financial institution may assess if you do not have sufficient funds in your account to cover the transfer. If your payment is returned unpaid by your financial institution you agree to pay a returned payment fee pursuant to your Agreement. You agree to update your Payment Method, if there is change in the Payment Method information, such as account information or expiration date. To facilitate automatic payments, Ava may receive updated account information from your card issuer.

You may cancel your enrollment in automatic payments at any time. However, you understand this authorization will remain in full force and effect until Ava has received written or oral notification from you of its termination. Any such cancellation must be received at least five business days before the scheduled date of the transfer to afford Ava and your financial institution a reasonable opportunity to act on it. If you revoke your automatic payment authorization, or Ava or your financial institution cannot process your automatic payment, you remain responsible for paying your monthly payments and any amounts due upon cancellation of service, including by making monthly payments by check on or before the due date on each bill. Promotional discounts or incentives that require automatic payments will be removed if your account is de-enrolled from automatic payments. We will notify you of any changes to

this agreement by email, a notice in your monthly statement or a message in your online account portal.

To stop your automatic payments, please login to your online account and turn off automatic payments.
